RMCA Letter regarding the Public Places and the Prevention of Noise Nuisances Amendment By-law

Rosebank, the 15 May 2020

To the City of Cape Town,

The City of Cape Town Streets, Public Places and the Prevention of Noise Nuisances Amendment By-law, 2020 refers.

The City of Cape Town claims that the proposed amendments to its nuisance by-laws are primarily threefold:

  1. i)  to ensure more effective resolution of complaints from the public;
  2. ii)  utilisation of the amended powers of Law Enforcement Officers,
  3. iii)  and an expansion of ways in which the City can recover costs,

We, the citizens of this city, and specifically, the members of the RMCA, hereby lodge a comprehensive objection to the proposed amendment. It is with grave concern that we note the proposed alienation and violation of our basic rights as stated in both the constitution of South Africa and common law.
