Motion proposed: OCA to intervene as an amicus curiae in the matter of City of Cape Town v Moore N.O. and Others; Case Number: 8919/19.
The Observatory Civic Association held its Special General Meeting on the 12th of January 2021. The purpose of the Special General was for the OCA to consult its members as mandated by the constitution to discuss and decide(vote) on whether the OCA should join as an amicus curiae (‘Friend of the Court’) in the matter state above.
The original resolution on the matter to be discussed by the SGM was sent on the 28th of December 2020. After discussion and consultation, the original resolution was amended and withdrawn then the amended resolution was sent to all OCA members on 12th January 2020.
The meeting was chaired by the Chairperson of the OCA who explained the background on why the SGM was called. There was a general discussion and questions posed, after which the members voted. It was agreed that members who shared a device could email in their vote afterwards or could whatsapp Edwin their vote by no later than midnight of 12 January.
The final vote count after WhatsApp and Email entries was:
In Favour: 60, Not in Favour: 1, Abstentions: 1
The resolution was therefore adopted by an overwhelming majority of the OCA members who participated.
